The triviYEAH website and service (the "Service") is operated by Lytical, Inc., a Massachusetts corporation ("Lytical," "we," "us," or "our"). triviYEAH is a product of Lytical, Inc. The Service itself, and all the trademarks (including the triviYEAH name and logo), copyright, database rights, and other intellectual property rights related to it, still belong to Lytical, Inc.

The Service allows users to submit trivia questions and other content ("User Content"). By submitting User Content, you:
Virtual Currency
The Service features a virtual currency called "dollas" used for gameplay purposes only. All mentions of dollars, $, dollas, or any other currency is strictly fictional and to be used as a means for gameplay only. Any wagers, transactions, or purchases done during the course of gameplay are fictional. Lytical, Inc. does not pay out any winnings to any user at any time. Virtual currency has no real-world monetary value and cannot be exchanged, refunded, or transferred. We reserve the right to modify virtual currency balances at any time.

Account Termination
You may delete your account at any time through the Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Service Changes and Availability
We are committed to ensuring that the Service is as useful and efficient as possible. For that reason, we reserve the right to make changes to the Service or to charge for its services, at any time and for any reason. We will never charge you for the Service without making it very clear to you exactly what you're paying for.
The Service requires an active internet connection. We cannot take responsibility for the Service not working at full functionality if you don't have internet access. You are responsible for any data charges from your mobile provider.
We may wish to update or stop providing the Service at any time. Upon any termination: (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Service.

LYTICAL, INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY TRIVIA CONTENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYTICAL, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF THE SERVICE; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SERVICE; OR (E) ANY CONTENT OBTAINED FROM THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Lytical, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of such courts.
